BJP should seek impeachment of Justice Arijit Pasayat for his premeditated anti-Gujarat judgements and pronouncements

He has done it again. He has finally hit his ultimate target – Narendra Modi. That was Pasayat’s brief. ‘We have to fix Modi, some way or the other. We must neutralize him.’  Pasayat was ready to do the job even if it meant throwing all caution to the wind. He was in a big hurry to do it. Modi’s armor had to be penetrated. Pasayat was given the task to shoot the lethal arrow. 

All judgements related to the Gujarat riot cases delivered by Pasayat are are an affront to the federal principles enshrined in our Constitution and defy logic, and most common principles of justice. They dent the credibility of a very important democratic institution.


The BJP and its leaders must ask the Chief Justice to form a Constitution Bench to review and rescind every judgement of Arijit Pasayat with regard to the Gujarat riot cases, starting from the Best Bakery case. They should form a panel of eminent jurists to push the matter, and put up a high profile legal fight, and seek dismissal and impeachment of this ‘chappal khor’, corrupt, vindictive, shameless, and dishonorable judge.

This is the only way to send a message to the highest judiciary that it should back off and not ever try to either encroach upon the legislative and executive turf, or work hand in glove with it. If the Marxists and the Congress parties can make a mockery of the legitimate judicial pronouncements of the highest court, what stops the BJP to fight for their perfectly justified and constitutionally valid cause? Why are they being so pusillanimous? They should have protested strongly over Mayaben Kodanani’s arrest. They should have been targeting Pasayat for being hand in glove with the Congress party and Teesta.

Pasayat has been working according to a script prepared by old courtroom fixers like Kapil Sibal and Harish Salve, wily secularists and liars like Teesta, and a vindictive an vile Sonia Maino. Sibal had already given an indication of the impending judgement in one of his media interviews a few weeks ago. He had openly said that very soon even Narendra Modi would be behind bars.


Look at the way Pasayat asked the SIT to investigate Modi even before the lawyers of the victim could make a presentation.  He actually acted on his own. He had come prepared to do the needful. I am sure that Justice Ganguly, the other judge in the two-judge bench, was not allowed by Pasayat to intervene in the matter.

The entire exercise of constituting the SIT was aimed at cornering Modi and the Hindutva forces and fixing them one way or the other. They used this subterfuge since they could not get the CBI (Congress Bureau of Investigation) to do their hatchet job because the permission of the state government was needed to do so.


Modi and the BJP leadership have faltered. They should have resisted the unconstitutional interference of Pasayat in matters of the state government of Gujarat right from the beginning. They allowed Pasayat to get away with murder when he ordered the bizarre retrial of the Best Bakery Case. Generally, a Supreme court judgement of this kind sets a precedent. Probably, for the first time in the history of jurisprudence in independent India, a Supreme Court judge delivered a judgement that is not used as a reference or precedence by our courts. He has made an exception of all Gujarat riot cases, that are concocted police cases of usual kinds, based on fake and faltu evidence of tutored witnesses. 

When Zahira Sheikh refused to change her Vadodara court testimony in the retrial of the BBC, Pasayat was so livid that he wrote a long judgement to send her behind bars for one year, instead of six months, for contempt of court.  The fact was that Teesta Setlwad had misled the court in the case. Pasayat did not even say a single word to her. He refused to hear Zahira’s plea that she was motivated and tutored by Teesta and Javed Akhtar to appeal to the Supreme Court.


Pasayat probably is the only judge of the Supreme Court to have suffered the ignominy to have been hit by a chappal thrown at him by a woman litigant. An angry Pasayat was going to put her behind bars instantly on the contempt of court charges. He had even delivered the judgment. However, Justice Ganguly prevented him from executing his orders and later a three-judge bench let the woman go.

Pasayat must go. He is a blot on the name of judiciary. He has colluded with the ruling elite and liars like Teesta Setalvad. It has been confirmed by the SIT report that Teesta had been tutoring witnesses and creating false evidence. In spite of that report, Pasayat went ahead and asked the SIT to carry on with the investigations and unearth new witnesses somehow. Pasayat was also upset that the SIT report was leaked. Why? Why did he want to suppress the truth? I have a feeling that he is directly in touch with the top echelons of the ruling elite and is doing everything as per its wish.

He is no more a protector of the Constitution. He is obviously prejudiced against Modi and the Gujarat government and seems to have some kind of a personal animus towards Modi. Pasayat has compromised the integrity of the highest court and his blatantly biased and one-sided judgments have made a mockery of justice and fair play.


Khullamkhula also feels that Pasayat’s links with Teesta and ruling party fixers like Kapil Sibal must be investigated.

If this does not happen, the BJP should openly criticize the Supreme Court and its judges and censure them for their open bias against Hindus. Since all our democratic institutions have been co-opted by the Sonia regime, it is necessary that people are educated that Supreme Court judges can also act as stooges of the ruling class and they are capable of being as corrupt as anyone else.

In the meantime, all Hindus must unite and stand up with Modi. He is the Prithviraj Chauhan of India, under attack from wily enemies like Ghori and traitors like Jaichand. We cannot let him fall because if we do, we will be politically marginalized forever.
