What about playing the role of a hangman Justice Khare?
This is the new credo of the Supreme Court- hang everyone who are indicted by media reports. If Mahesh Bhatt, Shabana Aazmi, Arundhati Roy, and the rest of the celebrity brigade says that Narendra Modi is a criminal, he is certainly one. The purpose of trial in such a case is to hang him one way or the other. Why should the highest court care for the rights of an accused to get a fair trial? In order to facilitate the hanging process, witnesses will now be allowed to backtrack their submissions. If this is not enough, a suitable court will be found in some corner of India and special prosecutors will be employed to ensure the intended conviction - hanging till the accused is declared dead. The justice must be seen to be delivered from the POV of the secularists and the media.
The Supreme Court will now have multiple interpretations of the laws of the land, to suit the mood of sundry judges, celebrity secularists, and the media. Who cares if these interpretations contradict each other and are an insult to rational thinking? 'Lalooisation' of the judiciary is fast progressing. The day is not far when India will be known as a land of 'Laloos'.
What about taking over the governance of this country Justice Khare and what about rewriting the constitution?Don't you think you are out of your mind Justice Khare? Your jaded mind cannot even comprehend the stupidity of your approach. You must have been a Congress appointee. This party has always been blind to reason. It has always nurtured hard headed nitwits and goons. You seem to belong to either of these two species Justice Khare? When are you going to join the Congress party? Are not you ashamed that the Supreme Court under your leadership was turned into a banana court? It delivered crazy judgements. From 'No right to strike' to 'Best Bakery', these are all horrendous and despicable judgements that have turned the Indian Supreme Court into a laughing stock the world over. They were bad, biased, bogus, and motivated interpretations of constitutional provisions and procedures.
Justice Khare's mind is the prime illustration of the fact that the judiciary is going bonkers. Some of the judgements and pronouncements that are being passed by the higher courts of this land are bizarre. The Supreme Court's judgement in Best Bakery case has already been discussed at Khullamkhulla. Look at the latest judgement of the Patna High Court. The court has asked clarifications about how the 'Bahubali' characters languishing in jails have been allowed to contest elections? This time the judges wished to fix Shahabuddins, Pappu Yaadavs, and Ranjit Dons. The learned Judges are so heavily impacted and blinded by various media reports by the kiddo journalists of all hues and cries, who pretend to be all knowing media pundits, that they have done the unthinkable. They have asked the Election Commission to consider the accused as convicted criminals. It looks as if Laloo has had an inspiring effect on these judges. And the whiz kids of media are tomtomming this joke as a landmark judgement. Very soon the Election Commission will take this cue and recommend amendments in the election laws. Someone will file a PIL in the Supreme Court and madcap megalomaniacs like Khare, Passayat, and Raju will pronounce that the accused should be treated as convicts till their acquittal.
How can we stop this 'media disease', that afflicts our constitutional bodies like the Supreme Court and the Election Commission that enjoy absolute power, from spreading?
You can vote Rao and Vajpayee out of the government. You cannot vote Passayat and Raju out of the Supreme Court. One could not vote Seshan, Lyngdoh, and Gill out of the election commission either. Absolute power went to their heads and these third rate incompetent bureaucrats were transformed into whimsical megalomaniacs overnight who turned the conduct of a straightforward, low key election process into a ludicrous media event. They also did their best to please their erstwhile bosses and benefactors. They fixed election dates as per their own sweet will. They created ridiculous codes of conduct. They passed personal comments deriding and demeaning political leaders, and gloated in the knowledge that they had absolute power over the fate of the politicians.
However, they mucked up their basic task of compiling a correct voters' list. They disenfranchised a large number of Indian citizens by their carelessness. It was a kind of rank incompetence that has never happened in the past. Why did it happen? Possibly, because the secularists were not there to raise hue and cry over this. If you recall, Lyngdoh insisted on counting each and every Muslim in Gujarat to be included in the voter's list. He delayed elections for this reason alone. Why did he do this? The Church sponsored NGOs wanted him to do that because it suited the strategies of their favourite leader Sonia Gandhi and her party.Many of these retired CECs did not take much time to get on to the political bandwagon. They generally found cosy company in the Congress party. One is waiting as to how long Lyngdoh is going to take before jumping on to the Congress bandwagon. He must be working for the Congress in the NortheastThings are so bad that the election commission keeps the nation under suspended animation for two months when neither state nor central governments can take any decisions and there is none to question the EC. If you question them, the political party that benefits from the EC's decision, projects it as an attack on a democratic institution.
We should have questioned the EC for having an extended election schedule that was going to last for more than twenty days. We should have also questioned it for delaying elections in Andhra Pradesh under all kinds of pretexts. In fact the EC was following into the footsteps of Lyngdoh who did his best to stop Narendra Modi from coming back to power. This time the target was the BJP and its allies. The parliament was dissolved in February and the EC has taken full two and half months to complete the election process. We have had elections within a month of the dissolution of the parliament. This is how it should be. The EC should be ready to hold elections even at a short notice instead of sitting in judgement. Power hungry T.N.Seshan, the buffoon, corrupted the whole process. The ineptness and partisan attitude of the EC is established beyond doubt now. It allowed Laloo Yaadav to make a mockery of the election process in Bihar. Its observers stood there as silent spectators.
Likewise if certain secularists, media men, celebrities, communists and the Congressmen feel that the Supreme Court's decision serves their political agenda, the downright ridiculous and wrong judgements of the court are hailed as triumph of justice. Whereas, a decision that does not suit them is pooh-poohed as non-sensical and bad.
Look at the bizarre methods that are used to influence the judiciary. Whenever Gujarat related PILs come up for hearing in the supreme court, the secularists like Teesta Setalwad parade much celebrated bastards like Mahesh Bhatt in front of the judges. It works. It is so easy to influence these judges. One can expect a bizarre judgement in the IIM fees cut issue too because an icon like Narayan Murthy is supporting the cause of an inept and corrupt faculty and other officials who do not want their acts of omission and commission to be probed by the government. We must question the Indian judiciary. Khullamkhulla demands that it should be put on record as to who appointed the judges in our higher courts. The proceedings of the courts in all PILs should be telecast live. The criticism of the judiciary should be allowed. If we can criticize our politicians openly, why cannot we criticize the judges who were actually appointed by these politicians?
Are we really turning into a banana state? Who is responsible for this? Most of the blame should go to the media, TV media in particular. These good looking guys and girls don't even know what they are doing. They are all walking talking shit pots whose upper chamber is full of 'gobar and gas'. They have trivialized everything. There are times when you feel like catching them by the scruff of their neck and giving them some tight hard slaps. It works in actuality. One has noticed that if you deal with these guys a bit aggressively, they can be fixed and put in their respective places. It may make them think in a better and most balanced way. Civilized behaviour cannot control an upstart and a little bit of thrashing and spanking helps in disciplining him/her. It is a traditional cure. Let us call it 'Chandrshekhar's Ballia Treatment'. It worked well on Jethmalani at one point of time.
When will the sense prevail? Those who can do something about it are the politicians. They are not as stupid as they are projected to be. However, they are caught up in bitter partisan politics and useless power games. They are busy managing their vote banks. In this process they are ignoring the dangers posed to our democratic polity by a publicity seeking judiciary, power crazy election commission, and a third class media establishment that is busy in painting politicians bad, aided and abetted by some jokers among page three celebrities and columnists.
Khullamkhulla calls on Indian politicians to do something about these issues before it is too late. Every institution that is vested with absolute powers must be watched very carefully and even a small hint of misuse of power should be questioned and constitutional safeguards should be put in place.
Let the new parliament discuss and debate these things very carefully, keeping aside the personal and party interests of the elected representatives. It must not care for what the media and some foolish self styled opinion leaders have to say about the matter.
If it is not done in time, the courts and autonomous bodies like the Election Commission will succeed in subverting our democracy and may even try to take over the task of governance in their hands. They can hold the entire country and governments to ransom in the name of some 'code of conduct'. Judiciary is already doing it. It has been ordering the executive around for quite some time now. It is high time they are rebuffed and put in place. You don't know what some crazy judges are capable of doing.
However, it does not absolve our political leadership of the charge of misgovernance. Laloo type politicians must learn to govern in the interest of democracy and our people. They must develop a grand vision of their own and work towards its realization. Why are they giving some stupid judges the opportunity to take over their job?
